Turning  Tourists into Criminals

CITIES OF MARCO & NAPLES TOTAL COMBINED

Approximately 4,500 Tourists became criminals after visiting the City of Naples in 19 years

Approximately 30% of all tourist convictions were PIER or BEACH related offences

CITY OF NAPLES CODE 2007

Sec. 42-53. Conduct on fishing pier and parking area.
(a)   Prohibited conduct; unlawful acts.  

On the city fishing pier and the parking area, no person shall: 

 

(1)   Dive or jump from the pier.
(2)   Swim or operate a boat within 150 feet of the pier.
(3)   Bring or allow pets on the pier.
(4)   Place fish in trash containers.
(5)   Possess alcoholic beverages.
(6)   Use the railing or benches for cleaning or cutting bait or fish.
(7)   Fish with more than 1 line or pole at one time.
(8)   Bed down or sleep on the pier, beach or parking area.
(9)   Deface, damage or defile the premises.
(10)   Litter the premises.
(11)   Post notices or posters, except on bulletin boards.
(12)   Use restrooms for changing clothes.
(13)   Operate or be in possession of a bicycle or scooter, or use a skateboard, roller skates or inline skates on the pier.
(14)   Fish for shark.
(15)   Beach a shark within the vicinity of the pier.
(16)   Use traps, nets, seines or other trapping or netting devices.
(17)   Use devices utilizing combustible fuels.
(18)   Use or possess any fishing reel on the pier in excess of the size of 4/0 or equal or use any fishing reel with a side plate of more than 4 inches in diameter.
(19)   Use a float for fishing from the pier in excess of 4 inches in diameter. Under no circumstances shall anyone use plastic bags as a floating device for fishing.

Note: Only 0.8% of all tourist related crimes were DISORDERLY CONDUCT. This indicated that most tourists are law abiding.

So why are so many tourists being convicted of criminal activities, on or near the beach, the areas we promote for tourists to enjoy themselves? Clearly, the signage is inadequate and words should be replaced with icons as the county signage does (see below) and secondly these relatively minor offences should NOT be criminal offences but civil infractions which, do not carry a jail sentence.

 

City of Naples Cites Tourists for riding Bicycle on the Beach

The City of Naples beach access signage indicates no VEHICLES on the beach, yet they continually cite tourists for BICYCLES on the beach

 

Naples tourists have been cited for riding a bicycle on their beach. According to local City Police, they consider a bicycle as a vehicle in Naples even though most dictionaries disagree 

CITY OF NAPLES - CODE OF ORDINANCES - Sec. 36-31. Vehicles on beaches - It shall be unlawful for any person to use or cause to be used any automobile, truck or vehicle of any kind, including but not limited to mopeds and bicycles, on the beaches in the city, with the exception of trucks or equipment used for the purpose of cleanup, repair or public safety, upon approval of the city manager. (Code 1957, § 23-3; Code 1994, § 62-36)
